An adult man who has been arrested by the police, allegedly fingered a ten year old girl the day before he was allegedly caught having sex with the child, reliable sources have told the Times.
The man, said to be in his thirties, is expected to be slapped with two separate charges tomorrow.
The charges are: unlawful sexual connection and having sexual intercourse with someone under the age of twelve.
Both alleged incidents occurred this week in Castries.
Under the criminal code of Saint Lucia, a person who has sexual intercourse with someone under the age of twelve, whether or not consent was given, is liable on indictable conviction – which is before a Judge and Jury and not before a Magistrate, to life imprisonment.
The law applies even if the perpetrator believes that the victim is twelve years or older.
Unlawful sexual connection under the criminal code is defined as the introduction to any extent into the vagina or anus of another person, any body part of another person or any object held or manipulated by another.
The law does not apply in the case of an authentic medical examination.
Earlier this week an eyewitness told the Times that he saw an adult male having sex with the minor female in a shop that is operated by her relatives.
The child had been left alone in the business place while the mother and grandmother went on an errand, the Times was informed.
According to the eyewitness, the little girl was fully clothed except for her undergarment, while the man was naked from the waist down.
The eyewitness reported that when he raised an alarm, the adult man fled and was later arrested by the police.
He told the Times that the alleged rapist could be seen frequently hanging around the shop in which the alleged incident took place and had apparently befriended members of the child’s family.
According to the eyewitness, the child reported that the alleged perpetrator had threatened her.
He told the Times that the child had requested that her mother not be told about the alleged incident.
